This Privacy Policy ("Policy") describes how Servamind Inc., a Delaware corporation ("Servamind," "we," "us," or "our"), collects, uses, discloses, and otherwise processes personal information in connection with our websites located at servamind.com and serva.servamind.com, our mobile application "Serva" (when available), and any other online or offline services that link to this Policy (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree with this Policy, please do not access or use our Services.
‍

This Privacy Policy should be read in conjunction with our Terms of Service, available at servamind.com/terms. Capitalized terms not defined herein shall have the meanings ascribed to them in the Terms of Service.
‍

Servamind provides an AI technology platform for data encoding and decoding (utilizing our proprietary .serva format), data pre-processing, and AI training services. Our Services are designed for developers, the general public, and investors, and are offered globally with a primary focus on the European Union and the United States.

2. Information We Collect

We collect personal information in several ways, as described below.

2.1 Information You Provide Directly

We collect information that you voluntarily provide to us when you use our Services, including:
‍

  • Contact Information: We collect your name, email address, phone number, and mailing address when you complete forms on our websites, register for an account, make purchases, or otherwise communicate with us.

  • Account Credentials: When you create an account, we collect your login credentials. Our authentication system (Auth UI) supports registration and sign-in via Google, Apple, Microsoft, or email.
    ‍
  • Payment Information: When you make a purchase, payment information is collected and processed by our third-party payment processor, Stripe. Servamind does not store full payment card numbers. We may receive limited transaction information from Stripe, such as the last four digits of your card, transaction amount, and billing address.

  • Customer Data: We collect data that you upload to our platform for encoding, decoding, or processing into our proprietary .serva format ("Customer Data"). You retain ownership of your Customer Data, and we process it solely to provide the Services.

You are not required to provide personal information to us; however, if you choose not to provide certain information, you may not be able to access or use certain features of our Services.
‍

2.2 Information Collected Automatically

When you access or use our Services, we automatically collect certain information, including:
‍

  • Log Data: We collect information that your browser or device sends whenever you visit our websites, including your Internet Protocol (IP) address, browser type and version, the pages of our Services that you visit, the date and time of your visit, the time spent on those pages, and other diagnostic data.

  • Usage Data and Analytics: We use Prometheus to collect analytics data about how you interact with our Services, including features used, actions taken, and performance metrics.
    ‍

Please note that Servamind does not currently collect device information (such as device identifiers or operating system information), precise location data, biometric data, health information, or government-issued identification numbers through automated means.

2.3 Information from Third-Party Sources

We may receive personal information about you from third-party sources, including:

  • Authentication Data: When you choose to sign in using a social login provider (Google, Apple, or Microsoft), we receive certain profile information from that provider, such as your name, email address, and profile picture, in accordance with your privacy settings with that provider.

  • Payment Transaction Data: We receive transaction confirmation and limited payment information from Stripe to fulfill and manage your orders.
    ‍

3. How We Use Your Information

We use the personal information we collect for the following purposes:

  • Provide and Maintain the Services: To operate our platform, including encoding, decoding, and processing data into .serva format, and to deliver the features and functionality you request.

  • Process Payments: To process transactions and send related information, including purchase confirmations and invoices, through our payment processor, Stripe.
    ‍
  • Customer Support: To respond to your inquiries, provide technical assistance, and address your concerns via our help desk software and email at legal@servamind.com.
    ‍
  • Account Management: To create, maintain, and secure your account, and to communicate with you about your account.
    ‍
  • Marketing Communications: To send you promotional communications about our products, services, and events, subject to your email opt-in consent. You may opt out of marketing communications at any time.
    ‍
  • Product Improvement and Analytics: To analyze usage patterns, monitor the performance of our Services, and improve our platform using analytics tools such as Prometheus.
    ‍
  • Analytics and Research: To conduct research and analysis to better understand how users interact with our Services and to develop new features and offerings.
    ‍

Servamind does NOT use your personal information for:
‍

  • Automated decision-making or profiling that produces legal or similarly significant effects
  • Automated content personalization based on personal information
  • Targeted advertising using your personal information
  • Cross-device tracking
    ‍

Servamind does not sell or rent your personal information to third parties.
‍

4. AI and Data Processing Practices

Servamind's core Services involve processing your data using artificial intelligence and proprietary algorithms. This section describes our AI and data processing practices.
‍

  • Data Encoding and Decoding: When you upload data to our platform, Servamind processes it to create compressed files in our proprietary .serva format. This encoding process transforms your data using proprietary compression algorithms. Your original data can be decoded back to its original format using our Services. Original uploaded files are deleted from Servamind's systems after processing is complete.

  • AI Training on Behalf of Customers: Servamind may train AI models on behalf of customers using their data, but only at the customer's express direction and pursuant to a separate written agreement governing such services.
    ‍
  • Use of Customer Data for Servamind's AI Models: Servamind does not use identifiable Customer Data to train its own proprietary AI models without your explicit consent.
    ‍
  • Aggregated and De-Identified Data: Servamind may use aggregated, de-identified data derived from use of the Services to improve its algorithms, develop new features, and enhance our services. This data does not identify you personally. You may opt out of the use of such data for machine learning model training by contacting us at legal@servamind.com. Any such opt-out will be effective within fourteen (14) days of receipt and will apply on a prospective basis only; it does not affect aggregated or de-identified data generated prior to the opt-out.

5. Business Customer Data Processing Terms
‍

5.1 Business Customer Data Processing

Where Servamind processes personal data on behalf of business customers in the course of providing the Services, Servamind acts as a data processor and processes such data only on documented instructions from the customer, as set forth in this Policy and the Terms of Service. Business customers, acting as data controllers, remain responsible for ensuring the lawfulness of the personal data they submit for processing. Servamind will inform you if, in its opinion, any processing instruction infringes applicable data protection law.

5.2 Personnel and Confidentiality

Servamind ensures that personnel authorized to process personal data on behalf of business customers are subject to appropriate confidentiality obligations and that access to such personal data is limited to those personnel who require access to perform the Services.
‍

5.3 Sub-Processors

Servamind may engage the third-party service providers listed in Section 6.1 (Service Providers) as sub-processors in connection with the Services. By using the Services, you authorize the engagement of those sub-processors. Servamind imposes data protection obligations on each sub-processor that are no less protective than those described in this Policy and remains responsible for the acts and omissions of its sub-processors to the same extent it would be liable if performing the services directly.
‍

5.4 Data Subject Requests and Breach Notification

To the extent you receive a request from an individual exercising rights under applicable data protection law with respect to personal data processed by Servamind on your behalf, Servamind will provide reasonable assistance to help you fulfill that request within applicable legal timeframes. You, as the data controller, remain responsible for responding to such requests. In the event of a personal data breach affecting personal data processed on your behalf, Servamind will notify you without undue delay and, where feasible, within seventy-two (72) hours of becoming aware of the breach, including such details as are available regarding the nature, scope, and likely consequences of the breach and the measures taken or proposed to address it.

5.5 Data Processing Agreements

Enterprise customers with specific compliance requirements under the General Data Protection Regulation (GDPR), the United Kingdom GDPR, or other applicable data protection laws may request a separately negotiated Data Processing Agreement by contacting us at legal@servamind.com.

6. How We Share Your Information

We may share your personal information in the following circumstances:

6.1 Service Providers

We engage third-party service providers to perform functions on our behalf and to help us operate our Services. These service providers have access to personal information only as necessary to perform their functions and are obligated to maintain the confidentiality and security of such information. Our service providers include:
‍

  • Stripe: Payment processing services
  • Prometheus: Analytics and monitoring services
  • Auth UI: Authentication and identity verification services
  • Help Desk Software: Customer support and ticketing services
  • Amazon Web Services (AWS) and OVH Cloud: Cloud hosting and data storage services

6.2 Advertising Partners

Servamind participates in the Google advertising network (Google Ads), LinkedIn Ads, X Ads, and Reddit Ads for the purpose of marketing our own Services. We do not sell your personal information to advertising partners or use your personal information for third-party advertising purposes.

6.3 Other Disclosures

We may also disclose your personal information in the following circumstances:
‍

  • Legal Requirements: We may disclose your information if required to do so by law or in response to valid legal process, including court orders, subpoenas, or requests from law enforcement or government authorities.
  • Protection of Rights and Safety: We may disclose your information when we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a government request.
  • Business Transfers: In connection with, or during negotiations of, any merger, acquisition, sale of assets, financing, or transfer of all or a portion of our business to another company, your personal information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on our website of any change in ownership or uses of your personal information.

Servamind does not engage in the following practices:

  • Sell personal information as defined under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA)
  • Share personal information for cross-context behavioral advertising
  • Rent personal information to third parties

7. Cookies and Tracking Technologies

Servamind and our third-party partners use cookies and similar tracking technologies to collect information about your use of our Services.

Types of Technologies Used

  • Essential/Functional Cookies: These cookies are necessary for the operation of our websites and enable core functionality such as security, network management, and accessibility. You cannot opt out of these cookies.
  • Analytics/Performance Tracking: We use Prometheus to collect analytics data about how you interact with our Services. This helps us understand usage patterns and improve our platform.
  • Advertising Tracking: We use Google Ads for marketing our own Services. Google may use cookies to measure the effectiveness of our advertising campaigns.

Your Choices
  • Browser Settings: Most web browsers allow you to control cookies through their settings. You can set your browser to refuse all or some cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, some parts of our Services may become inaccessible or not function properly.
  • Do Not Track Signals: Servamind honors Do Not Track (DNT) browser signals. When we detect a DNT signal, we limit our collection and use of your information accordingly.
  • Global Privacy Control: Servamind honors Global Privacy Control (GPC) signals. When we detect a GPC signal, we treat it as a valid opt-out request.
  • Google Ads Opt-Out: You can opt out of personalized advertising from Google by visiting https://adssettings.google.com or by using the Google Ads Settings.

8. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, as described in this Privacy Policy, unless a longer retention period is required or permitted by law.

  • Customer Data: Customer Data uploaded for processing is retained during the term of your account and for a period of thirty (30) days following termination or expiration of your account, unless you request earlier deletion or a different retention period is specified in a separate agreement.
  • Account Information: We retain your account information for as long as your account is active and for a reasonable period thereafter to comply with our legal obligations, resolve disputes, and enforce our agreements.
  • Deletion Upon Account Termination: Upon account deletion or service termination, Customer Data will be deleted within thirty (30) days, unless retention is required by law or for legitimate business purposes.
  • Extended Retention: Some information may be retained for longer periods if required by applicable law or for legitimate business purposes, including fraud prevention, compliance with legal obligations, and the establishment, exercise, or defense of legal claims.

9. Data Security

Servamind takes the security of your personal information seriously and implements appropriate technical and organizational measures to protect it against unauthorized access, alteration, disclosure, or destruction.

  • Encryption: Servamind uses user-set passwords to encode data into our proprietary .serva format. User passwords are immediately deleted from our systems after the encoding process is complete. Data is encrypted in transit using Servamind's proprietary encryption method, which is part of our novel lossless compression technology.
  • Data Breach Response: Servamind maintains a data breach response plan to promptly identify, contain, and remediate security incidents, and to notify affected individuals and authorities as required by applicable law.
  • Verification Methods: When you submit a data subject request, we verify your identity using email verification, account login, or two-factor authentication to protect your information from unauthorized access.

While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee the absolute security of your information.

10. Your Privacy Rights

Depending on your jurisdiction, you may have certain rights regarding your personal information. This section describes the rights available under various state privacy laws.

10.1 Your U.S. State Privacy Rights

If you are a resident of California, Virginia, Colorado, Connecticut, Indiana, Kentucky, or another U.S. state with applicable consumer privacy legislation, you may have the following rights with respect to your personal information:

  • Right to Know/Access: You have the right to request that we disclose what personal information we have collected about you, including the categories of personal information, the sources from which it was collected, the business or commercial purposes for collection, the categories of third parties with whom we share it, and the specific pieces of personal information we have collected about you.
  • Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions permitted by law.
  • Right to Correct: You have the right to request that we correct inaccurate personal information we maintain about you.
  • Right to Data Portability: You have the right to receive a copy of your personal information in a portable and, to the extent technically feasible, readily usable format.
  • Right to Opt Out: You have the right to opt out of the sale or sharing of your personal information, the processing of your personal information for targeted advertising, or profiling in furtherance of decisions that produce legal or similarly significant effects. Servamind does not sell personal information as defined under applicable state privacy laws; however, we provide an opt-out mechanism for any sharing for advertising purposes.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.
  • Right to Limit Use of Sensitive Personal Information (California residents): You have the right to limit our use and disclosure of sensitive personal information to uses necessary to perform the Services.
  • Right to Appeal (non-California residents): If we decline to take action on your request, you have the right to appeal our decision. We will inform you in writing of any action taken or not taken in response to an appeal, including a written explanation of the reasons for the decision.

10.2 How to Exercise Your Rights

To exercise any of the rights described above, you may submit a request by:

Verification: To protect your privacy and security, we will verify your identity before responding to your request. Verification methods may include email verification, account login, or two-factor authentication. If you use an authorized agent to submit a request on your behalf, we may require proof of authorization and may still require you to verify your identity directly with us.
‍

Response Time: We will respond to your request within forty-five (45) days of receipt. If we require additional time, we will inform you of the reason and extension period in writing. We may extend the response period by an additional forty-five (45) days when reasonably necessary.
‍

Authorized Agents: You may designate an authorized agent to submit a request on your behalf. We may require the authorized agent to provide proof of written permission from you and may require you to verify your identity directly with us.
‍

10.3 Do Not Sell or Share My Personal Information

Servamind does not sell your personal information as defined under applicable state privacy laws.

To opt out of any sharing of your personal information for advertising purposes, you may:
‍

  • Email us at legal@servamind.com with the subject line "Do Not Share My Personal Information"
  • Enable a recognized opt-out preference signal, such as Global Privacy Control (GPC), in your browser. We will honor such signals as valid opt-out requests.

11. Children's Privacy

Our Services are not directed to individuals under the age of eighteen (18), and we do not knowingly collect personal information from individuals under 18. If you are a parent or guardian and believe that your child under 18 has provided us with personal information, please contact us at legal@servamind.com, and we will take steps to promptly delete such information from our systems.

Because our Services are not available to individuals under the age of eighteen (18), we do not sell or share the personal information of minors.

If you believe an individual under 18 has provided personal information to Servamind, please contact us immediately at legal@servamind.com.

12. International Data Transfers

Servamind Inc. is based in the United States. If you access our Services from outside the United States, including from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please be aware that your personal information will be transferred to, stored, and processed in the United States.

By using our Services, you consent to the transfer of your personal information to the United States and acknowledge that your information may be subject to access by law enforcement and other government entities in accordance with applicable U.S. laws.

Servamind takes steps to protect your personal information in accordance with this Privacy Policy regardless of where it is processed. For transfers of personal data from the European Economic Area, United Kingdom, or Switzerland to the United States, Servamind relies on your consent as the lawful transfer mechanism.

13. Third-Party Links and Services

Our Services may contain links to third-party websites, applications, or services that are not owned or controlled by Servamind. This Privacy Policy applies only to our Services and does not apply to any third-party websites or services.

We are not responsible for the privacy practices of any third parties. We encourage you to review the privacy policies of any third-party websites or services before providing any personal information to them.

14. Changes to This Privacy Policy

Servamind may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make changes, we will revise the "Last Updated" date at the top of this Policy.
